NERC has transferred the regulatory authority over Enugu Electricity Market to the State Government.

 

NewsOnline Nigeria reports that the Nigerian Electricity Regulatory Commission (NERC) has transferred the regulatory oversight of the Enugu electricity market to the Enugu Electricity Regulatory Commission (EERC), which is owned by the state government with effect from May 1, 2024.

 

In a historic move, the Nigerian Electricity Regulatory Commission (NERC) has made a landmark decision to delegate its regulatory authority to the Enugu State Government, marking the first-ever transfer of powers to a state government electricity regulator. This unprecedented move sets a new precedent in the country’s electricity sector.

This disclosure is contained in a memo issued by NERC and signed by its Chairman, Sanusi Garba, and Commissioner Legal, Licensing and Compliance, Dafe Akpeneye, on April 22, 2024.

 

The policy shift may be in response to the earlier amendment of part of the constitution which removed the power sector from the exclusive legislative list with the Federal Government in sole control and decentralization of power generation, transmission and distribution to federating units.

 

The decentralization of the electricity market was achieved in March 2023 when former President Muhammadu Buhari assented to the amendment of relevant portions of Nigeria’s constitution.
