Glo, NCC Dragged to Court Over Alleged ₦20bn Breach of 2.6GHz Spectrum Contract

Glo and NCC have been dragged to court over alleged ₦20bn breach of 2.6GHz Spectrum Contract.

 

NewsOnline Nigeria reports that telecommunications firm Glo Mobile Limited, the Nigerian Communications Commission (NCC), and indigenous company Megatech Engineering Limited have been dragged before the Federal High Court in Abuja over an alleged breach of contract.

 

The suit was filed by Mosakab Nigeria Limited and its promoter, Mashood Mustapha, who are seeking over ₦20 billion in damages for what they described as an unlawful breach of a consultancy agreement.

In the case marked FHC/ABJ/CS/1534/2024, the plaintiffs are asking the court to void or set aside the sale of the 2.6GHz spectrum licence by Megatech Engineering Limited to Glo Mobile, alleging that the transaction was tainted by fraud and illegality.

 

Megatech Engineering Limited, Glo Mobile Limited, and the NCC are listed as the first, second, and third defendants respectively.

The suit, filed by George Ibrahim, SAN, of the Ogwu James Onoja, SAN, law firm, also seeks an order compelling Megatech to fulfil its alleged financial obligation of $10 million arising from a consultancy agreement executed on June 29, 2017.

 

In addition, the plaintiffs are requesting an order directing the NCC to revoke the 2.6GHz spectrum licence issued to Megatech in March 2020, which they claim was secured through their consultancy services.

 

According to the statement of claim, Mosakab Nigeria Limited was engaged by Megatech in 2017 to facilitate the procurement of the 2.5/2.6GHz spectrum licence for national operations. The plaintiffs maintain that they fully discharged their obligations under the agreement and are entitled to $9,578,947 as outstanding payment.

 

They are also seeking ₦50 million as the cost of litigation.

 

Justice Mohammed Garba Umar of the Federal High Court, Abuja, has fixed March 3, 2026, for the hearing of the suit.
